We have been instructed to act on behalf of the Seller with regard to the above-mentioned development and we have set out below brief details by way of information only to prospective purchasers.
THE DEVELOPMENT
The development is situated off St Mary''s Way, Rawtenstall, near to the Asda Superstore. We are instructed to initially deal with the sale of 16 of the properties being built on the site which consist of 12 three-storey townhouses and 2 pairs of semi-detached dwellings. Prospective purchasers should be aware however that the layout of the development and the type and total scope of dwellings or other buildings proposed to be erected thereon may vary from time to time. The Seller will not be bound by the current layout and scope or nature of development.

THE SELLER

We are instructed by Scanlons Consultant Surveyors LLP, LPA receivers for the developer of the site, Hurstwood Developments Limited who are now in administration.

TENURE

The 16 houses are all being sold by way of a Lease for a term of 999 years from 1 July 2009 at an initial annual ground rent of 150 per annum which will increase every 10 years during the term up to the fiftieth anniversary.
There will also be a service charge payable in relation to the estate management and maintenance. A resident management company, limited by guarantee, is to be set up to have responsibility for the estate maintenance and the management company will be party to the Lease. The purchaser of each dwelling will be required to become a member of the management company.

ESTATE MANAGEMENT

Stevens Scanlon are to act as managing agents for the resident management company. They will deal with all aspects of estate management and prepare a budget for the anticipated expenditure. The estate roads and sewers serving the dwellings will be privately managed as will the landscaping and parking areas on the development. The initial budget analysis for such anticipated expenditure is yet to be prepared.

PLANNING AND BUILDING REGS

The Seller has obtained a detailed planning consent which includes the initial 16 units to be offered for sale and has also obtained building regulation consent from Rossendale Borough Council.

NHBC COVER

The 16 dwellings will each have the benefit of NHBC Buildmark cover with the purchasers obtaining their pack of documents on exchange of contracts. Once the properties are ready for occupation the Seller will obtain cover notes from the NHBC as confirmation of such. The Sellers will also provide Energy Performance Certificates and certification under the Code for Sustainable Homes for each dwelling.
